You are permitted to view and purchase digital images from this site. You are not permitted to copy, take or or duplicate any images on this site without permission from Gus Martinez Photography. Any use or reproduction of Gus Martinez Photography digital images without prior agreement or purchase is prohibited.
Agreement upon Check Out
By purchasing a digital image from Gus Martinez Photography you are agreeing to be bound by these Terms and Conditions of Use. Please read this agreement before you download or purchase any image.
Acceptable Use
After purchasing a digital image(s) may be used for personal, non-commercial use only. The digital image may be used by one person (the purchaser) for printing for personal use or display on one personal computer. The purchased image file may be temporarily transferred via digital media to be printed for personal use by a professional printer – one time only.
Usage Limitations
- For permission to print more than 6 of Gus Martinez Photography digital images contact Gus Martinez to negotiate a new license agreement and contract.
- No digital images or prints may be shared or copied.
- No digital image or prints may be sub-licensed, resold, distributed, or otherwise made available for use or distribution.
- You may not alter an image obtained from Gus Martinez Photography (www.gmtzphotography.com) or remove Gus Martinez Photography copyright information imbedded in the digital image file.
Commercial Use
If are interested in using any images for commercial purposes contact Gus Martinez Photography. The pricing and terms of commercial use will be established by mutual agreement at that time. Any digital image by Gus Martinez Photography, purchased or obtained from the website, or any portion of an image, may not be used without consent in any final materials distributed to the public for advertising and marketing materials or any on-line, broadcast or other electronic distribution system, communication, web pages, marketing or promotional materials, multimedia projects, video, graphic design projects, and general creative works, and may not be distributed, sub-licensed or made available for use or distribution separately or individually.
Grant of License
Gus Martinez Photography grants to you use of purchased digital images (commonly delivered via email attachment) subject to the Acceptable Use, Usage Limitations, and Unauthorized Usage. No rights are granted until payment is received in full.
Gus Martinez Photography retains full rights to her digital images. You may not transfer or duplicate images without prior payment and written consent.
Limited Warranty
Gus Martinez Photography warrants that for a period of 90 days from the date of delivery of the digital image(s), as evidenced by your receipt, that the digital image, under normal use, will be free from defects. Gus Martinez Photography liability, and your remedy, under this warranty, will be Gus Martinez Photography option to replace the digital image, or to refund the purchase price and terminate this agreement.
Termination of Agreement
This Agreement will automatically terminate upon failure by you, the licensee, to comply with any of its terms. If this happens, you hereby agree to destroy all copies and archives of the Gus Martinez Photography digital images, to cease using the images for any purpose, and to confirm to Gus Martinez Photography in writing that you have complied with these requirements.
Gus Martinez Photography reserves the right to discontinue the license of the digital image for any reason, and to elect to replace the image(s) with an alternative. Upon notice of any discontinuance of a license, you agree not to further use the discontinued digital image. Gus Martinez Photography reserves the right to commence legal proceedings if copyright infringement has ensued from unauthorized use of Gus Martinez Photography digital images.
